    Another hearing scheduled in Stop & Shop vs. Cernak Buick lawsuit over proposed Easthampton supermarket

    Lawyers involved in the more than three-year-old Stop & Shop-Cernak lawsuit will be back in court Thursday, bringing an old matter back before Judge Bertha D. Josephson. In March, Superior Court Judge C. Jeffrey Kinder ruled that there was no violation of due process during Planning Board proceedings, but in April he scheduled the new hearing on the first count of the lawsuit, which argues that the Planning Board's decision to issue the permit to Stop & Shop in January 2010 was "arbitrary, capricious and contrary to law."
